Telangana RERA orders Aliens Developers to pay ₹1.3 crore, execute sale pact for Tellapur project
HYDERABAD: The Telangana Real Estate Regulatory Authority (TGRERA) has directed Aliens Developers Pvt Ltd to execute a registered agreement of sale and pay over ₹1.3 crore to a homebuyer for delays and non-compliance with the Real Estate (Regulation and Development) Act, 2016.
Buyer alleged non-issuance of agreement, delay in project
The complainant, Upendra Deep, stated that he booked Flat No. 2222 in Station-4 of the “Aliens Space Station” project at Tellapur in November 2019. The total cost was ₹93.18 lakh, of which he paid ₹19.11 lakh — about 20% of the consideration — while the rest was to be financed through a bank loan under a construction-linked payment plan.
Despite multiple follow-ups, the developer did not issue a formal agreement of sale as mandated under Section 13 of the Real Estate (Regulation and Development) Act, 2016, nor did it provide documents required to secure a home loan. Deep alleged that even after four years, construction at Station-4 had not progressed and no timeline for completion was provided.
The developer allegedly began demanding more payments and issued a pre-cancellation notice dated November 16, 2023, for the flat, prompting the buyer to approach TGRERA.
Authority directs execution of sale agreement within 10 days
After hearing both parties, the Authority, exercising powers under Section 37 of the RERA Act, ordered the developer to execute a registered agreement for sale with the complainant within ten days, as per the provisional allotment letter dated July 28, 2021.
TGRERA further directed the developer to:
- Complete the project within the validity of its RERA registration.
- Handover possession promptly upon completion.
- Provide all necessary documents to the complainant for securing a housing loan.
The Authority warned that failure to comply would attract proceedings under Section 63 of the Act. The complaint was disposed of with no order on costs.
